Chapter 1
تَمَامُ حَدِيثِ أُسَيْدِ بْنِ حُضَيْرٍ (١)، ١٧٩٨٦ - حَدَّثَنَا رَوْحٌ، حَدَّثَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي عِكْرِمَةُ بْنُ خَالِدٍ، عَنْ أُسَيْدِ بْنِ حُضَيْرٍ (٢) الْأَنْصَارِيِّ، ثُمَّ أَحَدِ بَنِي حَارِثَةَ، أَنَّهُ أَخْبَرَهُ أَنَّهُ كَانَ عَامِلًا عَلَى الْيَمَامَةِ، وَأَنَّ مَرْوَانَ كَتَبَ إِلَيْهِ: أَنَّ مُعَاوِيَةَ كَتَبَ إِلَيْهِ: أَيُّمَا رَجُلٍ سُرِقَ مِنْهُ سَرِقَةٌ، فَهُوَ أَحَقُّ بِهَا بِالثَّمَنِ حَيْثُ وَجَدَهَا، قَالَ: فَكَتَبْتُ (٣) إِلَى مَرْوَانَ: " أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَضَى أَنَّهُ إِذَا، ، كَانَ الَّذِي ابْتَاعَهَا مِنَ الَّذِي سَرَقَهَا غَيْرَ مُتَّهَمٍ، خُيِّرَ سَيِّدُهَا، فَإِنْ شَاءَ أَخَذَ الَّذِي سُرِقَ مِنْهُ بِالثَّمَنِ، وَإِنْ شَاءَ اتَّبَعَ سَارِقَهُ "، قَالَ: وَقَضَى بِذَلِكَ أَبُو بَكْرٍ، وَعُمَرُ، وَعُثْمَانُ رَضِيَ اللهُ تَعَالَى عَنْهُمْ (١)، ،
It is narrated from Usaid bin Hudair (may Allah be pleased with him) that he was the governor of Yamama. Once, Marwan wrote a letter to him stating that Amir Muawiyah (may Allah be pleased with him) had written to him that if a person's belonging is stolen, then he is most entitled to its price, wherever it may be found. I wrote back to Marwan that the Prophet (ﷺ) had decided that if someone buys something from a thief and that person himself is not accused, then the owner of the property will have the choice: if he wishes, he may buy his stolen item back by paying its price, or if he wishes, he may pursue the thief. And this is the same decision that the three rightly guided Caliphs (may Allah be pleased with them) had given. The previous hadith is also narrated through this second chain of transmission.

حَدَّثَنَا عَبْدُ الرَّزَّاقِ، حَدَّثَنَا ابْنُ جُرَيْجٍ، قَالَ: سَأَلْتُ عَطَاءً فَذَكَرَ مِثْلَهُ، قَالَ: سَمِعْنَا (١) أَنَّهُ يُقَالُ خُذْ مَالَكَ حَيْثُ وَجَدْتَهُ (٢) ، وَلَقَدْ أَخْبَرَنِي (٣) عِكْرِمَةُ بْنُ خَالِدٍ، أَنَّ أُسَيْدَ بْنَ ظُهَيرٍ (٤)، ، الْأَنْصَارِيَّ، ثُمَّ أَحَدَ بَنِي حَارِثَةَ، أَخْبَرَهُ أَنَّهُ كَانَ عَامِلًا عَلَى الْيَمَامَةِ، فَذَكَرَ مَعْنَاهُ (١)،
Abd al-Razzaq narrated to us, Ibn Jurayj narrated to us, he said: I asked Ata, and he mentioned the like of it. He said: We heard that it is said: "Take your wealth wherever you find it." And Ikrimah ibn Khalid informed me that Usayd ibn Zuhayr al-Ansari, then one of the Banu Haritha, informed him that he was an official over al-Yamamah, and he mentioned its meaning.

حَدَّثَنَا هَوْذَةُ بْنُ خَلِيفَةَ، حَدَّثَنَا ابْنُ جُرَيْجٍ، قَالَ: حَدَّثَنِي عِكْرِمَةُ بْنُ خَالِدٍ، أَنَّ أُسَيْدَ بْنَ حُضَيْرِ بْنِ سِمَاكٍ، حَدَّثَهُ قَالَ كَتَبَ مُعَاوِيَةُ إِلَى مَرْوَانَ بْنِ الْحَكَمِ إِذَا سُرِقَ الرَّجُلُ فَذَكَرَ الْحَدِيثَ (٢)، ،
Narrated to us by Hawdhah ibn Khalifah, narrated to us by Ibn Jurayj, he said: Ikrimah ibn Khalid narrated to me, that Usayd ibn Hudayr ibn Simak narrated to him, he said: Muawiyah wrote to Marwan ibn al-Hakam regarding when a man steals, then he mentioned the hadith.
