حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا سُفْيَانُ، عَنْ أَبِي إِسْحَاقَ، عَنِ النَّجْرَانِيِّ، عَنِ ابْنِ عُمَرَ، قَالَ: " ابْتَاعَ رَجُلٌ مِنْ رَجُلٍ نَخْلًا، فَلَمْ يُخْرِجْ تِلْكَ السَّنَةَ شَيْئًا، فَاجْتَمَعَا، فَاخْتَصَمَا إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " بِمَ تَسْتَحِلُّ دَرَاهِمَهُ؟ ارْدُدْ إِلَيْهِ دَرَاهِمَهُ، وَلَا تُسْلِمُنَّ فِي نَخْلٍ حَتَّى يَبْدُوَ صَلَاحُهُ " فَسَأَلْتُ مَسْرُوقًا: مَا صَلَاحُهُ؟ قَالَ: " يَحْمَارُّ أَوْ يَصْفَارُّ " (٢)، ،

Translation

English translation

It is narrated from Ibn Umar (may Allah be pleased with them both) that a man made a sale by salam (advance payment) for dates from another man’s tree, but that year the tree bore no fruit. When he wanted to take his money back, the seller refused. The man came to the Prophet Muhammad (ﷺ). The Prophet (ﷺ) asked the owner of the trees, “Did your trees not bear fruit?” He replied, “No.” The Prophet (ﷺ) said, “Then why are you withholding his money?” So he returned his money to him. After that, the Prophet (ﷺ) forbade making a sale by salam until the fruit ripens.
