حَدَّثَنَا رَوْحٌ، حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي حَفْصَةَ، حَدَّثَنَا ابْنُ شِهَابٍ، عَنْ سَالِمٍ، عَنْ أَبِيهِ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، فَذَكَرَ ذَلِكَ إِلَى عُمَرَ، فَانْطَلَقَ عُمَرُ إِلَى رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَهُ، فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " لِيُمْسِكْهَا حَتَّى تَحِيضَ غَيْرَ هَذِهِ الْحَيْضَةِ، ثُمَّ تَطْهُرَ، فَإِنْ بَدَا لَهُ أَنْ يُطَلِّقَهَا فَلْيُطَلِّقْهَا كَمَا أَمَرَهُ اللهُ عَزَّ وَجَلَّ، وَإِنْ بَدَا لَهُ أَنْ يُمْسِكَهَا فَلْيُمْسِكْهَا " (١)،

Translation

English translation

It is narrated from Ibn Umar (may Allah be pleased with them both) that he divorced his wife while she was in her "period of menstruation," and he also informed Umar (may Allah be pleased with him) about this matter. Umar (may Allah be pleased with him) presented himself in the court of the Messenger of Allah (ﷺ) and informed the Prophet (ﷺ) about it. The Prophet (ﷺ) said: "He should keep her with him until she becomes pure from that period, then another period comes and she becomes pure from that as well. Then, if he decides to divorce her, he may divorce her according to the command of Allah, and if he decides to keep her, he may keep her."
