حَدَّثَنَا يَعْقُوبُ، حَدَّثَنَا أَبِي، عَنِ ابْنِ إِسْحَاقَ، حَدَّثَنِي عُمَرُ بْنُ حُسَيْنِ بْنِ عَبْدِ اللهِ مَوْلَى آلِ حَاطِبٍ، عَنْ نَافِعٍ مَوْلَى عَبْدِ اللهِ بْنِ عُمَرَ، عَنْ عَبْدِ اللهِ بْنِ عُمَرَ قَالَ: تُوُفِّيَ عُثْمَانُ بْنُ مَظْعُونٍ، وَتَرَكَ ابْنَةً لَهُ (٤) مِنْ خُوَيْلَةَ بِنْتِ حَكِيمِ بْنِ أُمَيَّةَ بْنِ حَارِثَةَ بْنِ الْأَوْقَصِ قَالَ: وَأَوْصَى إِلَى أَخِيهِ قُدَامَةَ بْنِ مَظْعُونٍ، قَالَ عَبْدُ اللهِ: وَهُمَا خَالَايَ، قَالَ: فَخَطَبْتُ إِلَى قُدَامَةَ بْنِ مَظْعُونٍ ابْنَةَ عُثْمَانَ بْنِ مَظْعُونٍ فَزَوَّجَنِيهَا (٥) ، وَدَخَلَ الْمُغِيرَةُ بْنُ شُعْبَةَ - يَعْنِي إِلَى أُمِّهَا - فَأَرْغَبَهَا فِي الْمَالِ فَحَطَّتْ إِلَيْهِ، وَحَطَّتْ الْجَارِيَةُ إِلَى هَوَى أُمِّهَا، فَأَبَيَا حَتَّى ارْتَفَعَ أَمْرُهُمَا إِلَى رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ قُدَامَةُ بْنُ مَظْعُونٍ: يَا رَسُولَ اللهِ، ابْنَةُ أَخِي أَوْصَى بِهَا إِلَيَّ، فَزَوَّجْتُهَا ابْنَ عَمَّتِهَا عَبْدَ اللهِ بْنَ عُمَرَ، فَلَمْ أُقَصِّرْ بِهَا فِي الصَّلَاحِ، وَلَا فِي الْكَفَاءَةِ، وَلَكِنَّهَا، ، امْرَأَةٌ، وَإِنَّمَا (١) حَطَّتْ إِلَى هَوَى أُمِّهَا، قَالَ: فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " هِيَ يَتِيمَةٌ، وَلَا تُنْكَحُ إِلَّا بِإِذْنِهَا " قَالَ: فَانْتُزِعَتْ وَاللهِ مِنِّي بَعْدَ أَنْ مَلَكْتُهَا، فَزَوَّجُوهَا الْمُغِيرَةَ (٢) (٣)، ،

Translation

English translation

It is narrated from Ibn Umar (may Allah be pleased with them both) that when Uthman bin Maz'un (may Allah be pleased with him) passed away, among his heirs was a daughter who was born to Khawla bint Hakim bin Umayyah bin Harithah bin Al-Awqas. He had appointed his brother, Qudamah bin Maz'un (may Allah be pleased with him), as his executor. Both of them were my maternal uncles. I sent a marriage proposal for myself to Uthman's daughter through Qudamah (may Allah be pleased with him), which he accepted and married her to me. Meanwhile, Mughirah bin Shu'bah (may Allah be pleased with him) came to her mother and tempted her with wealth and riches, and she was swayed. The girl, seeing her mother's inclination, was also swayed, and both of them refused this relationship. Eventually, this matter was presented before the Prophet (ﷺ). Qudamah (may Allah be pleased with him) said, "O Messenger of Allah! She is my brother's daughter. He himself entrusted her matter to me. I married her to her paternal cousin, Abdullah bin Umar. I did not fall short in seeking a suitable match or in considering what was best and proper, but she is a woman and, seeing her mother's inclination elsewhere, is being swayed." The Prophet (ﷺ) said: "She is an orphan girl; her marriage should not be conducted without her permission." Ibn Umar (may Allah be pleased with them both) says: "By Allah, after she came into my possession, she was taken away from me and married to Mughirah bin Shu'bah (may Allah be pleased with him)."
