قَالَ: وَجَدْتُ فِي كِتَابِ أَبِي، حَدَّثَنَا يَزِيدُ، أَخْبَرَنَا شُعْبَةُ، عَنْ أَبِي إِسْحَاقَ، عَنْ رَجُلٍ مِنْ نَجْرَانَ، أَنَّهُ سَأَلَ ابْنَ عُمَرَ فَقَالَ: إِنَّمَا أَسْأَلُكَ عَنِ اثْنَتَيْنِ: (٣) عَنِ الزَّبِيبِ وَالتَّمْرِ، وَعَنِ السَّلَمِ فِي النَّخْلِ، فَقَالَ ابْنُ عُمَرَ: أُتِيَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِرَجُلٍ سَكْرَانَ، فَقَالَ: إِنَّمَا شَرِبْتُ زَبِيبًا وَتَمْرًا، قَالَ: فَجَلَدَهُ الْحَدَّ، (٤) وَنَهَى عَنْهُمَا أَنْ يُجْمَعَا. قَالَ: وَأَسْلَمَ رَجُلٌ فِي نَخْلٍ لِرَجُلٍ، فَقَالَ: لَمْ تَحْمِلْ نَخْلُهُ ذَلِكَ الْعَامَ، فَأَرَادَ أَنْ يَأْخُذَ دَرَاهِمَهُ، فَلَمْ يُعْطِهِ، فَأَتَى بِهِ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، ، فَقَالَ: " لَمْ تَحْمِلْ نَخْلُهُ؟ " قَالَ: لَا. قَالَ: " فَفِيمَ (١) تَحْبِسُ دَرَاهِمَهُ؟ "، قَالَ: فَدَفَعَهَا إِلَيْهِ، قَالَ: وَنَهَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ (٢) عَنِ السَّلَمِ فِي النَّخْلِ حَتَّى يَبْدُوَ صَلَاحُهُ " (٣)، °
Translation
English translation
A man from Najran asked Ibn Umar (may Allah be pleased with them both) a question, saying: "I want to ask you about two things: one about raisins and dates, and the other about advance sale (salam) in date palm trees." Ibn Umar (may Allah be pleased with them both) said: "Once, a man who was drunk was brought to the Prophet (ﷺ). He admitted to drinking wine made from raisins and dates. The Prophet (ﷺ) prescribed the legal punishment for him and forbade combining the two (raisins and dates in making wine). Also, a man made an advance sale (salam) for dates on another man's trees, but that year the trees bore no fruit. When he wanted to take his money back, the other refused. The man came to the Prophet (ﷺ), who asked the owner of the trees: 'Did your trees not bear fruit?' He replied, 'No.' The Prophet (ﷺ) said: 'Then why are you withholding his money?' So he returned his money to him. After that, the Prophet (ﷺ) forbade advance sale (salam) in fruits until they ripen."
