حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، وَعَبْدُ اللهِ بْنُ بَكْرٍ، قَالَا: حَدَّثَنَا سَعِيدٌ، عَنْ قَتَادَةَ، عَنْ يُونُسَ بْنِ جُبَيْرٍ، أَنَّهُ سَأَلَ ابْنَ عُمَرَ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، فَقَالَ: أَتَعْرِفُ عَبْدَ اللهِ بْنَ عُمَرَ؟ فَإِنَّهُ طَلَّقَ امْرَأَتَهُ حَائِضًا، (٢) فَانْطَلَقَ عُمَرُ إِلَى رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَهُ بِذَلِكَ، فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " مُرْهُ فَلْيُرَاجِعْهَا، ثُمَّ إِنْ بَدَا لَهُ طَلَاقُهَا طَلَّقَهَا فِي قُبُلِ عِدَّتِهَا " قَالَ: ابْنُ بَكْرٍ: " أَوْ فِي قُبُلِ طُهْرِهَا "، فَقُلْتُ لِابْنِ عُمَرَ: أَيُحْسَبُ طَلَاقُهُ (٣) ذَلِكَ طَلَاقًا؟ قَالَ: " نَعَمْ، أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ؟ " (٤)، ،
Translation
English translation
Yunus bin Jubair, may Allah have mercy on him, once asked Ibn Umar, may Allah be pleased with them both, about a man who divorces his wife during her menstrual period. He replied, "Do you know Abdullah bin Umar, may Allah be pleased with them both? He also divorced his wife during her menstrual period. Umar, may Allah be pleased with him, went and informed the Prophet, peace and blessings be upon him, about this. The Prophet, peace and blessings be upon him, said: 'Tell him to take her back, and then if he wants to divorce her, he should do so during her period of purity.'" I asked Ibn Umar, may Allah be pleased with them both, "Will that divorce be counted?" He replied, "Tell me, do you want to prove him foolish and ignorant?"
