حَدَّثَنَا إِسْمَاعِيلُ، أَخْبَرَنَا أَيُّوبُ، (١) عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: " أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْمُزَابَنَةِ، وَالْمُزَابَنَةُ أَنْ يُبَاعَ مَا فِي رُءُوسِ النَّخْلِ بِتَمْرٍ بِكَيْلٍ مُسَمًّى إِنْ زَادَ فَلِي، وَإِنْ نَقَصَ فَعَلَيَّ "، قَالَ ابْنُ عُمَرَ، حَدَّثَنِي زَيْدُ بْنُ ثَابِتٍ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " رَخَّصَ فِي بَيْعِ الْعَرَايَا بِخَرْصِهَا " (٢)، ، . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .، ، . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .، ،
Translation
English translation
It is narrated from Ibn Umar (may Allah be pleased with them both) that the Noble Prophet (ﷺ) forbade the sale of Muzabana. Muzabana means selling dates that are still on the trees according to a fixed estimate, and saying: "If more comes out, it is mine, and if less comes out, it is still mine." Ibn Umar (may Allah be pleased with them both) says that Ziyad bin Thabit (may Allah be pleased with him) narrated this hadith to me, that the Noble Prophet (ﷺ) permitted the sale of 'Ariya with estimation.
