حَدَّثَنَا أَبُو مُعَاوِيَةَ قَالَ: حَدَّثَنَا هِشَامُ بْنُ عُرْوَةَ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ قَالَتْ: كَانَ فِي بَرِيرَةَ ثَلَاثُ قَضِيَّاتٍ، أَرَادَ أَهْلُهَا أَنْ يَبِيعُوهَا وَيَشْتَرِطُوا الْوَلَاءَ، فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: " اشْتَرِيهَا فَأَعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ، قَالَتْ: وَعَتَقَتْ، فَخَيَّرَهَا رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَاخْتَارَتْ نَفْسَهَا، قَالَتْ: وَكَانَ النَّاسُ يَتَصَدَّقُونَ عَلَيْهَا، فَتُهْدِي لَنَا، فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: " هُوَ عَلَيْهَا صَدَقَةٌ، وَهُوَ لَكُمْ هَدِيَّةٌ، فَكُلُوهُ " (١)، ،
Translation
English translation
It is narrated from Aisha (may Allah be pleased with her) that three cases arose regarding Barirah. Her owners wanted to sell her and make the inheritance conditional for themselves. I mentioned this to the Prophet (ﷺ), so the Prophet (ﷺ) said: Buy her and set her free, because the inheritance of a slave belongs to the one who sets him free. When she was freed, the Prophet (ﷺ) gave her the choice to remain in the marriage or not, and she chose for herself (ended her marriage with her husband). Also, people used to give her something as charity, and she would give us some of it as a gift. I mentioned this to the Prophet (ﷺ), so the Prophet (ﷺ) said: It is charity for her and a gift for you from her, so you may eat it.
