حَدَّثَنَا عَفَّانُ، حَدَّثَنَا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ، حَدَّثَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ، عَنْ جَابِرٍ قَالَ: " قَضَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِالشُّفْعَةِ فِي كُلِّ مَا لَمْ يُقْسَمْ، فَإِذَا وَقَعَتِ الْحُدُودُ، وَصُرِّفَتِ الطُّرُقُ، فَلَا شُفْعَةَ " (٢)،
Translation
English translation
It is narrated from Jabir (may Allah be pleased with him) that the Prophet (ﷺ) established the right of pre-emption in every property that has not been divided. When boundaries are marked and the paths are separated, then the right of pre-emption no longer remains.
