Hadith of Ma'qil ibn Sinan al-Ashja'i (may Allah be pleased with him)

حَدِيثُ مَعْقِلِ بْنِ سِنَانٍ الْأَشْجَعِيِّ، ١٥٩٤٣ - حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، قَالَ: أَخْبَرَنَا سُفْيَانُ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنْ عَلْقَمَةَ، قَالَ: أُتِيَ عَبْدُ اللهِ فِي امْرَأَةٍ تَزَوَّجَهَا رَجُلٌ، ثُمَّ مَاتَ عَنْهَا، وَلَمْ يَفْرِضْ لَهَا صَدَاقًا، وَلَمْ يَكُنْ دَخَلَ بِهَا، قَالَ: فَاخْتَلَفُوا إِلَيْهِ، فَقَالَ: أَرَى لَهَا مِثْلَ صَدَاقِ نِسَائِهَا، وَلَهَا الْمِيرَاثُ، وَعَلَيْهَا الْعِدَّةُ فَشَهِدَ مَعْقِلُ بْنُ سِنَانٍ الْأَشْجَعِيُّ: " أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَضَى فِي بِرْوَعَ ابْنَةِ وَاشِقٍ بِمِثْلِ مَا قَضَى " (١)،

Alqamah narrates that a case was presented to Abdullah in which a woman had married a man, and shortly after, he passed away. He had neither fixed her dowry nor had they been alone together. What is the ruling regarding this? Various companions presented different opinions. Ibn Mas’ud said: My opinion is that this woman should receive a dowry similar to that of women like her, she will also receive a share in inheritance, and she will observe the waiting period (‘iddah). Upon hearing this decision, Ma’qil bin Sinan testified that the Prophet (ﷺ) had given exactly such a verdict regarding Barwa’ bint Washiq.

حَدَّثَنَا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ أَبِي شَيْبَةَ، قَالَ عَبْدُ اللهِ [بْنُ أَحْمَدَ] : وَسَمِعْتُهُ أَنَا مِنْ عَبْدِ اللهِ بْنِ مُحَمَّدِ بْنِ أَبِي شَيْبَةَ، قَالَ: حَدَّثَنَا ابْنُ فُضَيْلٍ، عَنْ عَطَاءِ بْنِ السَّائِبِ، قَالَ: شَهِدَ عِنْدِي نَفَرٌ مِنْ أَهْلِ الْبَصْرَةِ مِنْهُمُ الْحَسَنُ بْنُ أَبِي الْحَسَنِ،، ، عَنْ مَعْقِلِ بْنِ سِنَانٍ: أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مَرَّ بِهِ، وَهُوَ يَحْتَجِمُ لِثَمَانِ عَشْرَةَ، فقَالَ: " أَفْطَرَ الْحَاجِمُ وَالْمَحْجُومُ " (١)، ،

It is narrated from Ma'qil bin Sinan that once, on the eighteenth night of Ramadan, he was having cupping done when the Prophet (ﷺ) passed by him. Seeing him in this state, the Prophet (ﷺ) said: The one who does cupping and the one who gets it done, both their fasts are broken.
