حَدَّثَنَا يُونُسُ، حَدَّثَنَا لَيْثٌ، عَنْ نَافِعٍ، أَنَّ عَبْدَ اللهِ طَلَّقَ امْرَأَتَهُ، وَهِيَ حَائِضٌ تَطْلِيقَةً وَاحِدَةً عَلَى عَهْدِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ عُمَرُ: يَا رَسُولَ اللهِ، إِنَّ عَبْدَ اللهِ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً وَاحِدَةً وَهِيَ حَائِضٌ، " فَأَمَرَهُ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ يُرَاجِعَهَا، وَيُمْسِكَهَا حَتَّى تَطْهُرَ، ثُمَّ تَحِيضَ عِنْدَهُ حَيْضَةً أُخْرَى، ثُمَّ يُمْهِلَهَا حَتَّى تَطْهُرَ مِنْ حَيْضَتِهَا، فَإِنْ (٢) أَرَادَ أَنْ يُطَلِّقَهَا فَلْيُطَلِّقْهَا حِينَ تَطْهُرُ، قَبْلَ أَنْ يُجَامِعَهَا، فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللهُ تَعَالَى، أَنْ يُطَلَّقَ لَهَا النِّسَاءُ " وَكَانَ عَبْدُ اللهِ إِذَا سُئِلَ عَنْ ذَلِكَ قَالَ (٣) لِأَحَدِهِمْ: أَمَّا أَنْتَ طَلَّقْتَ امْرَأَتَكَ مَرَّةً أَوْ مَرَّتَيْنِ، " فَإِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَمَرَنِي بِهَا "، فَإِنْ كُنْتَ طَلَّقْتَهَا ثَلَاثًا، فَقَدْ حَرُمَتْ عَلَيْكَ حَتَّى تَنْكِحَ زَوْجًا غَيْرَكَ، وَعَصَيْتَ اللهَ تَعَالَى فِيمَا أَمَرَكَ مِنْ طَلَاقِ امْرَأَتِكَ (٤)، ،

Translation

English translation

Nafi’ (may Allah have mercy on him) says that once Ibn Umar (may Allah be pleased with them both) gave his wife a divorce while she was in her menstrual period. Umar Farooq (may Allah be pleased with him) asked the Prophet (ﷺ) about this issue, so the Prophet (ﷺ) ordered that he should take her back and wait until she has her menstrual period again and then wait until she becomes pure, then before approaching his wife, he may divorce her. This is the method according to which Allah has given men permission to divorce their wives. It was the practice of Ibn Umar (may Allah be pleased with them both) that when he was asked about a person who divorces his wife during her menstrual period, he would say: I had given my wife one or two divorces, and the Prophet (ﷺ) ordered me to take my wife back and wait for the next menstrual period and then for her to become pure, then before approaching her, to divorce her. Whereas you have given your wife three divorces; you have disobeyed the command of Allah which He has given you regarding divorcing your wife, and your wife has become unlawful for you until she marries another man besides you.
