حَدَّثَنَا رَوْحٌ، حَدَّثَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي أَبُو الزُّبَيْرِ، أَنَّهُ سَمِعَ عَبْدَ الرَّحْمَنِ بْنَ أَيْمَنَ يَسْأَلُ ابْنَ عُمَرَ وَأَبُو الزُّبَيْرِ يَسْمَعُ، فَقَالَ: كَيْفَ تَرَى فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ حَائِضًا؟ فَقَالَ: إِنَّ ابْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ عَلَى عَهْدِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ عُمَرُ: يَا رَسُولَ اللهِ، إِنَّ عَبْدَ اللهِ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " لِيُرَاجِعْهَا " عَلَيَّ، وَلَمْ يَرَهَا شَيْئًا، وَقَالَ: فَرَدَّهَا، " إِذَا طَهُرَتْ فَلْيُطَلِّقْ، أَوْ يُمْسِكْ "، قَالَ ابْنُ عُمَرَ: وَقَرَأَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: {يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ} [الطلاق: ١] فِي قُبُلِ عِدَّتِهِنَّ، قَالَ ابْنُ جُرَيْجٍ: " وَسَمِعْتُ مُجَاهِدًا يَقْرَؤُهَا كَذَلِكَ " (٣)، ، . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .، ، . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .، ،
Translation
English translation
Abdur Rahman bin Ayman (may Allah have mercy on him) once asked Ibn Umar (may Allah be pleased with them both) about the issue of divorce during menstruation. Abu Az-Zubair was listening to this conversation. Ibn Umar (may Allah be pleased with them both) said that he had divorced his wife during her menstruation. Umar (may Allah be pleased with him) went and informed the Prophet (ﷺ) about this. The Prophet (ﷺ) said: "Tell him to take her back, then if he wants to divorce her, he should do so during her period of purity." And the Prophet (ﷺ) also recited this verse from Surah Al-Ahzab in this manner: "O Prophet (ﷺ), when you people divorce your wives, then divorce them at the beginning of their waiting period" (meaning, divorce should be given during the period of purity, not during menstruation).
