حَدَّثَنَا عَبْدُ الرَّحْمَنِ، عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: " مَنْ بَاعَ نَخْلًا قَدْ (٣)، ، أُبِرَتْ، فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ " (١)،

Translation

English translation

It is narrated from Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (ﷺ) said: "Whoever sells a tree in which date palms have been pollinated, its fruit will belong to the seller, unless the buyer stipulates at the time of purchase (that I am buying this tree along with its fruit)."
