حَدَّثَنَا إِسْمَاعِيلُ، حَدَّثَنَا أَيُّوبُ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ قَالَ: لَا أَعْلَمُهُ إِلَّا عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: " مَنْ حَلَفَ فَاسْتَثْنَى فَهُوَ بِالْخِيَارِ: إِنْ شَاءَ أَنْ يَمْضِيَ عَلَى يَمِينِهِ، وَإِنْ شَاءَ أَنْ يَرْجِعَ غَيْرَ حَنِثٍ، أَوْ قَالَ: غَيْرَ حَرَجٍ " (٢)، ،
Translation
English translation
It is narrated, most likely as a marfu’ hadith, from Ibn Umar (may Allah be pleased with them both) that whoever says "In sha Allah" while taking an oath, has the choice: if he wishes to fulfill his oath, he may do so, and if he wishes to retract from it, he may do so without becoming a perjurer.
