حَدَّثَنَا سُفْيَانُ، عَنْ عَمْرٍو، عَنْ إِسْمَاعِيلَ الشَّيْبَانِيِّ، بِعْتُ مَا فِي رُءُوسِ نَخْلِي بِمِائَةِ وَسْقٍ، إِنْ زَادَ فَلَهُمْ، وَإِنْ نَقَصَ فَلَهُمْ، فَسَأَلْتُ ابْنَ عُمَرَ: فَقَالَ: " نَهَى عَنْهُ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ،، ، وَرَخَّصَ فِي الْعَرَايَا " (١)،
Translation
English translation
Ismail Shaybani (may Allah have mercy on him) says that once I sold the dates of my orchard for one hundred wasqs, whether they turned out to be more or less, they would belong to the buyer. Then I asked Ibn Umar (may Allah be pleased with them both) about this, and he said that the Noble Prophet (ﷺ) forbade this, but permitted the sale of ‘ariyah with estimation.
