حَدَّثَنَا عَبْدُ الرَّزَّاقِ، قَالَ: أَخْبَرَنَا ابْنُ جُرَيْجٍ، قَالَ: أَخْبَرَنِي سُلَيْمَانُ بْنُ مُوسَى، أَنَّ ابْنَ شِهَابٍ أَخْبَرَهُ، أَنَّ عُرْوَةَ أَخْبَرَهُ، أَنَّ عَائِشَةَ أَخْبَرَتْهُ، أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: " أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ، ، إِذْنِ مَوَالِيهَا (١) ، فَنِكَاحُهَا بَاطِلٌ - ثَلَاثًا - وَلَهَا مَهْرُهَا بِمَا أَصَابَ مِنْهَا، فَإِنْ اشْتَجَرُوا، فَإِنَّ السُّلْطَانَ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ " (٢)،
Translation
English translation
It is narrated from Aisha (may Allah be pleased with her) that the Prophet (ﷺ) said: If a woman marries without the permission of her guardian, her marriage is invalid, invalid, invalid. If consummation takes place, then due to this, the dowry will become obligatory upon her, and if people differ regarding this, then the ruler will be the guardian of the one who has no guardian.
