حَدَّثَنَا عَبْدُ الرَّزَّاقِ، حَدَّثَنَا مَعْمَرٌ، عَنْ الزُّهْرِيِّ، عَنْ حَرَامِ بْنِ مُحَيِّصَةَ، عَنْ أَبِيهِ، أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ رَجُلٍ فَأَفْسَدَتْهُ، فَقَضَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " عَلَى أَهْلِ الْأَمْوَالِ حِفْظَهَا بِالنَّهَارِ، وَعَلَى أَهْلِ الْمَوَاشِي حِفْظَهَا بِاللَّيْلِ " (٢)، ،

Translation

English translation

Haram bin Muhayyisah (narrates from his father) reports that the she-camel of Bara’ (may Allah be pleased with him) entered a garden and caused destruction in it, so the Noble Prophet (ﷺ) decided that during the day, the protection of the garden is the responsibility of its owners, and if at night an animal causes any damage, then the owner of the animal will be liable for that damage.
