حَدَّثَنَا إِسْحَاقُ هُوَ ابْنُ عِيسَى، حَدَّثَنَا مَالِكٌ، عَنِ الزُّهْرِيِّ، عَنْ حَرامِ بْنِ مُحَيِّصَةَ: أَنَّ نَاقَةً لِلْبَرَاءِ دَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ، فَقَضَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " أَنَّ عَلَى أَهْلِ الْحَوَائِطِ حِفْظَهَا بِالنَّهَارِ، وَأَنَّ مَا أَفْسَدَتِ الْمَوَاشِي بِاللَّيْلِ ضَامِنٌ عَلَى أَهْلِهَا " (١)، ، . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .، ،
Translation
English translation
Haram bin Muhayyisa (narrates from his father) reports that the she-camel of Bara’ (may Allah be pleased with him) entered a garden and caused destruction in it, so the Prophet Muhammad (ﷺ) decided that during the day, the protection of the garden is the responsibility of its owners, and if animals cause any damage at night, then the owner of the animal will be liable for that damage.
