حَدَّثَنَا عَبْدُ الرَّزَّاقِ، حَدَّثَنَا ابْنُ جُرَيْجٍ، حَدَّثَنِي ابْنُ شِهَابٍ، عَنِ الْقَسَامَةِ فِي الدَّمِ قَالَ: كَانَتِ الْقَسَامَةُ فِي الْجَاهِلِيَّةِ عَنْ حَدِيثِ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، وَسُلَيْمَانَ بْنِ يَسَارٍ، عَنْ رِجَالٍ مِنْ أَصْحَابِ النَّبِيِّ، صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مِنَ الْأَنْصَارِ: " أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَقَرَّهَا عَلَى مَا كَانَتْ عَلَيْهِ فِي الْجَاهِلِيَّةِ، وَقَضَى بِهَا بَيْنَ نَاسٍ مِنَ الْأَنْصَارِ فِي قَتِيلٍ ادَّعَوْهُ عَلَى الْيَهُودِ " (٢)، ،
Translation
English translation
It is narrated from an Ansari companion (may Allah be pleased with him) that in the time of ignorance, the practice of "Qasamah" was prevalent. The Prophet Muhammad (ﷺ) maintained it in the same manner as it was in the time of ignorance, and in the case of some Ansar—who belonged to Banu Harithah and had made a claim against the Jews—the Prophet Muhammad (ﷺ) gave the same ruling.
