Original Arabic
حَدَّثَنَا عَبْدُ اللهِ بْنُ بَكْرٍ، حَدَّثَنَا سَعِيدٌ يَعْنِي ابْنَ أَبِي عَرُوبَةَ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ، أَنَّ رَجُلًا غَشِيَ جَارِيَةَ امْرَأَتِهِ، وَهُوَ فِي غَزْوٍ، فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: " إِنْ كَانَ اسْتَكْرَهَهَا، فَهِيَ حُرَّةٌ مِنْ مَالِهِ، وَعَلَيْهِ شِرَاؤُهَا لِسَيِّدَتِهَا، وَإِنْ كَانَتْ طَاوَعَتْهُ، فَمِثْلُهَا مِنْ مَالِهِ لِسَيِّدَتِهَا " (٢)، ،
Translation
English translation
It is narrated from Salamah (may Allah be pleased with him) that during a battle, a man committed adultery with his wife's slave-girl. The Prophet (ﷺ) said: If he forced the slave-girl into this act, then she will be set free and the man will be liable to pay her the equivalent of a dowry. But if this act was done with her consent, then she will remain his slave-girl; however, the man will still have to pay the equivalent of a dowry.
