حَدَّثَنَا بَهْزٌ، وَعَفَّانُ الْمَعْنَى قَالَا: حَدَّثَنَا هَمَّامٌ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ قَالَ: عَفَّانُ، إِنَّ الْحَسَنَ حَدَّثَهُمْ، عَنْ هَيَّاجِ بْنِ عِمْرَانَ الْبُرْجُمِيِّ، أَنَّ غُلَامًا لِأَبِيهِ أَبَقَ فَجَعَلَ لِلَّهِ تَبَارَكَ وَتَعَالَى عَلَيْهِ (٢) إِنْ قَدَرَ عَلَيْهِ أَنْ يَقْطَعَ يَدَهُ. قَالَ: فَقَدَرَ، ، عَلَيْهِ. قَالَ: فَبَعَثَنِي إِلَى عِمْرَانَ بْنِ حُصَيْنٍ قَالَ: فَقَالَ: " أَقْرِئْ أَبَاكَ السَّلَامَ وَأَخْبِرْهُ أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ كَانَ " يَحُثُّ فِي خُطْبَتِهِ عَلَى الصَّدَقَةِ، وَيَنْهَى عَنِ الْمُثْلَةِ " فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَيَتَجَاوَزْ عَنْ غُلَامِهِ. قَالَ: وَبَعَثَنِي إِلَى سَمُرَةَ فَقَالَ: أَقْرِئْ أَبَاكَ السَّلَامَ وَأَخْبِرْهُ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ كَانَ " يَحُثُّ فِي خُطْبَتِهِ عَلَى الصَّدَقَةِ، وَيَنْهَى عَنِ الْمُثْلَةِ "، فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَيَتَجَاوَزْ عَنْ غُلَامِهِ. Translation

English translation

Hiyaj bin Imran says that the slave of his father ran away. He (his father) vowed in the name of Allah that if he gained power over him, he would cut off his hand. Later, that slave came under his control, so he sent me to Imran bin Husain (may Allah be pleased with him) to ask about this issue. He said, "Go to your father, convey my greetings, and say that he should give the expiation for his oath and not cut off any limb of his body, because the Prophet (ﷺ) used to encourage charity in his addresses and forbade mutilation." Then he sent me to Samurah bin Jundub (may Allah be pleased with him), and he also said the same.
