حَدَّثَنَا أَبُو دَاوُدَ الْحَفَرِيُّ، حَدَّثَنَا سُفْيَانُ، عَنْ قَيْسِ بْنِ مُسْلِمٍ، عَنْ طَارِقِ بْنِ شِهَابٍ قَالَ: قَالَ أَبُو مُوسَى: قَدِمْتُ مِنَ الْيَمَنِ قَالَ: فَقَالَ لِي النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " بِمَ أَهْلَلْتَ؟ " قَالَ: قُلْتُ بِإِهْلَالٍ كَإِهْلَالِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ. قَالَ: فَقَالَ: " هَلْ مَعَكَ مِنْ هَدْيٍ؟ " قَالَ: قُلْتُ: يَعْنِي لَا. قَالَ: فَأَمَرَنِي فَطُفْتُ بِالْبَيْتِ، وَبَيْنَ الصَّفَا، وَالْمَرْوَةِ، ثُمَّ أَتَيْتُ امْرَأَةً مِنْ قَوْمِي فَمَشَطَتْ رَأْسِي وَغَسَلَتْهُ، ثُمَّ أَحْلَلْتُ، فَلَمَّا كَانَ يَوْمُ التَّرْوِيَةِ أَهْلَلْتُ بِالْحَجِّ. قَالَ: فَكُنْتُ أُفْتِي النَّاسَ بِذَلِكَ إِمَارَةَ أَبِي بَكْرٍ وَعُمَرَ، فَبَيْنَا أَنَا وَاقِفٌ فِي سُوقِ الْمَوْسِمِ إِذْ جَاءَ رَجُلٌ فَسَارَّنِي فَقَالَ: إِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي شَأْنِ النُّسُكِ. قَالَ: قُلْتُ: أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فِي شَيْءٍ فَلْيَتَّئِدْ، فَهَذَا أَمِيرُ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَأْتَمُّوا. قَالَ: فَقَالَ لِي: إِنْ نَأْخُذْ بِكِتَابِ اللهِ تَعَالَى فَإِنَّهُ يَأْمُرُ بِالتَّمَامِ، وَإِنْ نَأْخُذْ بِسُنَّةِ نَبِيِّنَا صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَإِنَّهُ " لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْيَ " (١)، ،

Translation

English translation

It is narrated from Abu Musa (may Allah be pleased with him) that the Noble Prophet (ﷺ) sent me to the area of my people. When the season of Hajj approached, the Noble Prophet (ﷺ) set out for Hajj, and I also attained the honor of performing Hajj. When I presented myself before him, the Noble Prophet (ﷺ) was encamped at Abtah. He asked me, "O Abdullah bin Qais! With what intention did you put on Ihram?" I replied, "Saying 'Labbayk for Hajj as the Hajj of the Messenger of Allah (ﷺ).'" The Noble Prophet (ﷺ) said, "Very good. Tell me, did you bring a sacrificial animal with you?" I said, "No." The Noble Prophet (ﷺ) said, "Go and perform Tawaf of the House of Allah, perform Sa'i between Safa and Marwah, and come out of Ihram." So I went and did as the Noble Prophet (ﷺ) commanded. Then I went to a woman of my people, and she washed my head with 'khatmi' and looked for lice in my hair. Then, on the eighth of Dhul-Hijjah, I put on Ihram for Hajj. I continued to give people the same fatwa until the passing of the Noble Prophet (ﷺ), as he had commanded me. The same situation remained during the time of Abu Bakr (may Allah be pleased with him). When the time of Umar (may Allah be pleased with him) came, one day I was standing near the Black Stone and was telling people the same ruling that the Noble Prophet (ﷺ) had commanded me, when suddenly a man came and whispered to me, "Do not be hasty in giving this fatwa, because the Commander of the Faithful has issued some new rulings regarding the rites of Hajj." I said to the people, "O people! Whoever has received a fatwa from us regarding the rites of Hajj should wait, because the Commander of the Faithful is coming; you should follow him." Then when Umar (may Allah be pleased with him) came, I asked him, "O Commander of the Faithful! Have you issued any new rulings regarding the rites of Hajj?" He replied, "Yes! If we take the Book of Allah, it commands us to complete (the rites), and if we take the Sunnah of the Noble Prophet (ﷺ), he did not come out of Ihram until he had offered the sacrifice."
