حَدَّثَنَا يَعْقُوبُ، قَالَ: حَدَّثَنَا أَبِي، عَنِ ابْنِ إِسْحَاقَ قَالَ: حَدَّثَنِي سَعِيدُ بْنُ أَبِي سَعِيدٍ الْمَقْبُرِيُّ، عَنْ أَبِي شُرَيْحٍ الْخُزَاعِيِّ قَالَ: لَمَّا بَعَثَ عَمْرُو بْنُ سَعِيدٍ إِلَى مَكَّةَ بَعْثَهُ يَغْزُو ابْنَ الزُّبَيْرِ، أَتَاهُ أَبُو شُرَيْحٍ فَكَلَّمَهُ وَأَخْبَرَهُ بِمَا سَمِعَ مِنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ خَرَجَ إِلَى نَادِي قَوْمِهِ فَجَلَسَ فِيهِ، فَقُمْتُ إِلَيْهِ فَجَلَسْتُ مَعَهُ، فَحَدَّثَ قَوْمَهُ كَمَا حَدَّثَ عَمْرَو بْنَ سَعِيدٍ مَا سَمِعَ مِنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَعَمَّا قَالَ لَهُ عَمْرُو بْنُ سَعِيدٍ، قَالَ: قُلْتُ: يَا (١) هَذَا إِنَّا كُنَّا مَعَ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حِينَ افْتَتَحَ مَكَّةَ فَلَمَّا كَانَ الْغَدُ مِنْ يَوْمِ الْفَتْحِ عَدَتْ خُزَاعَةُ عَلَى رَجُلٍ مِنْ هُذَيْلٍ فَقَتَلُوهُ وَهُوَ مُشْرِكٌ، فَقَامَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِينَا خَطِيبًا فَقَالَ: " أَيُّهَا (٢) النَّاسُ، إِنَّ اللهَ عَزَّ وَجَلَّ حَرَّمَ مَكَّةَ يَوْمَ خَلَقَ السَّمَاوَاتِ، ، وَالْأَرْضَ، فَهِيَ حَرَامٌ مِنْ حَرَامِ اللهِ تَعَالَى (١) إِلَى يَوْمِ الْقِيَامَةِ، لَا يَحِلُّ لِامْرِئٍ يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ أَنْ يَسْفِكَ فِيهَا دَمًا، وَلَا يَعْضِدَ بِهَا شَجَرًا، لَمْ تَحْلِلْ لِأَحَدٍ كَانَ قَبْلِي، وَلَا تَحِلُّ لِأَحَدٍ يَكُونُ بَعْدِي، وَلَمْ تَحْلِلْ لِي إِلَّا هَذِهِ السَّاعَةَ غَضَبًا عَلَى أَهْلِهَا، أَلَا ثُمَّ قَدْ رَجَعَتْ كَحُرْمَتِهَا بِالْأَمْسِ، أَلَا فَلْيُبَلِّغِ الشَّاهِدُ مِنْكُمُ الْغَائِبَ، فَمَنْ قَالَ لَكُمْ إِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَدْ قَاتَلَ بِهَا فَقُولُوا: إِنَّ اللهَ عَزَّ وَجَلَّ قَدْ أَحَلَّهَا لِرَسُولِهِ وَلَمْ يُحْلِلْهَا لَكُمْ، (٢) يَا مَعْشَرَ خُزَاعَةَ، ارْفَعُوا (٣) أَيْدِيَكُمْ عَنِ الْقَتْلِ، فَقَدْ كَثُرَ أَنْ يَقَعَ، لَئِنْ قَتَلْتُمْ قَتِيلًا لَأَدِيَنَّهُ، فَمَنْ قُتِلَ بَعْدَ مَقَامِي هَذَا فَأَهْلُهُ بِخَيْرِ النَّظَرَيْنِ، إِنْ شَاءُوا فَدَمُ قَاتِلِهِ وَإِنْ شَاءُوا فَعَقْلُهُ "، ثُمَّ وَدَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الرَّجُلَ الَّذِي قَتَلَتْهُ خُزَاعَةُ فَقَالَ عَمْرُو بْنُ سَعِيدٍ لِأَبِي شُرَيْحٍ: انْصَرِفْ أَيُّهَا الشَّيْخُ، فَنَحْنُ أَعْلَمُ بِحُرْمَتِهَا مِنْكَ، إِنَّهَا لَا تَمْنَعُ سَافِكَ دَمٍ، وَلَا خَالِعَ طَاعَةٍ وَلَا مَانِعَ جِزْيَةٍ، قَالَ: فَقُلْتُ: قَدْ كُنْتُ شَاهِدًا، وَكُنْتَ غَائِبًا فَقَدْ بَلَّغْتُ، وَقَدْ أَمَرَنَا رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ يُبَلِّغَ شَاهِدُنَا غَائِبَنَا، وَقَدْ بَلَّغْتُكَ فَأَنْتَ وَشَأْنُكَ (٤)، ، °

Translation

English translation

It is narrated from Abu Shurayh that when Amr bin Sa'id intended to send his army towards Makkah to confront Abdullah bin Zubair, he went to him and spoke to him and informed him about the saying of the Prophet (peace be upon him). Then he came and sat in the gathering of his people, and I also went and sat with him. He narrated the hadith of the Prophet (peace be upon him) and then, mentioning the reply of Amr bin Sa'id, said: I said to him, "O so-and-so, on the occasion of the conquest of Makkah, we were with the Prophet (peace be upon him). The day after the conquest of Makkah, the Banu Khuza'ah attacked a man from Banu Hudhayl and killed him. The slain man was a polytheist. The Prophet (peace be upon him) stood among us to deliver a sermon and said: 'O people, Allah declared Makkah a sanctuary on the day He created the heavens and the earth, so it will remain a sanctuary until the Day of Resurrection. It is not permissible for anyone who believes in Allah and the Last Day to shed blood therein or to cut down its trees. It was not made lawful for anyone before me, nor will it be made lawful for anyone after me, and it was made lawful for me only for a short period because of Allah's wrath upon its people. Beware! Its sanctity has returned as it was yesterday. Let those who are present convey this to those who are absent. And if anyone among you says that the Prophet (peace be upon him) also fought in Makkah, then say: Allah made it lawful for the Prophet (peace be upon him), not for you. O group of Khuza'ah, now withhold your hands from killing, for it is enough. For the person you killed before this, I will pay his blood money. But after my standing in this place, whoever kills anyone, the heirs of the slain will have the choice of two things: either to take retribution from the killer or to accept blood money.' After that, the Prophet (peace be upon him) paid the blood money for the man whom Banu Khuza'ah had killed." Hearing this hadith, Amr bin Sa'id said to Abu Shurayh, "Old man, go back. We know its sanctity better than you. This sanctity cannot protect a blood-shedder, one who abandons obedience, or one who withholds jizyah." I said to him, "I was present at that time, you were absent, and the Prophet (peace be upon him) commanded us to convey it to those who were absent. So I have conveyed this command. Now it is up to you and your actions."
