حَدَّثَنَا مُوسَى، حَدَّثَنَا ابْنُ لَهِيعَةَ، عَنْ أَبِي الزُّبَيْرِ، قَالَ: سَأَلْتُ جَابِرًا عَنِ الرَّجُلِ يُوَالِي مَوَالِيَ الرَّجُلِ بِغَيْرِ إِذْنِهِ، فَقَالَ: كَتَبَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " عَلَى كُلِّ بَطْنٍ عُقُولَهُمْ "، ثُمَّ كَتَبَ: " إِنَّهُ لَا يَحِلُّ أَنْ يُوَالِيَ مَوَالِيَ رَجُلٍ بِغَيْرِ إِذْنِهِ " (٤)،
Translation
English translation
Abu al-Zubair says that I asked Jabir (may Allah be pleased with him) what is the ruling if a man enters into a contract of alliance (mu'alaat) with someone else without his master's permission? He replied that the Prophet (ﷺ) made it obligatory for every branch of the tribe to pay its share of blood money, and he also wrote that it is not permissible for anyone to enter into a contract of alliance with the slave of a Muslim man without his permission.
