حَدَّثَنَا حَجَّاجٌ، حَدَّثَنَا لَيْثٌ، قَالَ: حَدَّثَنِي عُقَيْلٌ، عَنِ ابْنِ شِهَابٍ، أَنَّهُ سُئِلَ عَنِ الرَّجُلِ يَجْمَعُ بَيْنَ الْمَرْأَةِ وَبَيْنَ خَالَةِ أَبِيهَا، وَالْمَرْأَةِ وَخَالَةِ أُمِّهَا، أَوْ بَيْنَ الْمَرْأَةِ وَعَمَّةِ أَبِيهَا، أَوِ الْمَرْأَةِ وَعَمَّةِ أُمِّهَا، فَقَالَ: قَالَ قَبِيصَةُ بْنُ ذُؤَيْبٍ: سَمِعْتُ أَبَا هُرَيْرَةَ، يَقُولُ: " نَهَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ يُجْمَعَ بَيْنَ الْمَرْأَةِ وَخَالَتِهَا، وَبَيْنَ الْمَرْأَةِ وَعَمَّتِهَا، فَنَرَى خَالَةَ أُمِّهَا، أوْ عَمَّةَ أُمِّهَا بِتِلْكَ الْمَنْزِلَةِ، وَإِنْ كَانَ مِنَ، ، الرَّضَاعِ يَكُونُ فِي (١) ذَلِكَ بِتِلْكَ الْمَنْزِلَةِ " (٢)،
Translation
English translation
Someone asked Imam Zuhri, may Allah have mercy on him, whether a man can combine in marriage a woman and her paternal aunt, or her maternal aunt, or her father's paternal aunt, or her own paternal aunt. He narrated this hadith of Abu Hurairah, may Allah be pleased with him, from Qabeesah bin Dhu’ayb, that the Prophet Muhammad, peace and blessings be upon him, forbade combining a woman and her aunt or paternal aunt in marriage. And our opinion is that her mother's aunt and paternal aunt also fall under this category, and if the relationship is through breastfeeding, then that too falls under this category.
