حَدَّثَنَا يَحْيَى بْنُ إِسْحَاقَ، أَخْبَرَنَا ابْنُ لَهِيعَةَ، عَنْ عُبَيْدِ اللهِ بْنِ أَبِي جَعْفَرٍ، عَنِ الْفَضْلِ بْنِ عَمْرِو بْنِ أُمَيَّةَ، عَنْ أَبِيهِ قَالَ: سَمِعْتُ رِجَالًا يَتَحَدَّثُونَ، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ: " إِذَا أُعْتِقَتِ الْأَمَةُ فَهِيَ بِالْخِيَارِ مَا لَمْ يَطَأْهَا، إِنْ شَاءَتْ فَارَقَتْهُ، وَإِنْ وَطِئَهَا، فَلَا خِيَارَ لَهَا وَلَا تَسْتَطِيعُ فِرَاقَهُ " (١)،
Translation
English translation
It is narrated from several Companions (may Allah be pleased with them) that the Noble Prophet (ﷺ) said: When a slave woman is granted her freedom, she is given the choice, provided that her husband has not had intercourse with her; if she wishes, she may separate from her husband. But if he has had intercourse with her, then she no longer has this choice and cannot separate from him.
