حَدَّثَنَا أَزْهَرُ، حَدَّثَنَا هِشَامٌ يَعْنِي الدَّسْتُوَائِيَّ، عَنْ أَبِي عِمْرَانَ الْجَوْنِيِّ، قَالَ: كُنَّا بِفَارِسَ وَعَلَيْنَا أَمِيرٌ يُقَالُ لَهُ زُهَيْرُ بْنُ عَبْدِ اللهِ، فَقَالَ: حَدَّثَنِي رَجُلٌ، أَنَّ نَبِيَّ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: " مَنْ بَاتَ فَوْقَ إِجَّارٍ، أَيْ فَوْقَ بَيْتٍ لَيْسَ حَوْلَهُ شَيْءٌ يَرُدُّ رِجْلَهُ، فَقَدْ بَرِئَتْ مِنْهُ، ، الذِّمَّةُ، وَمَنْ رَكِبَ الْبَحْرَ بَعْدَ مَا يَرْتَجُّ، فَقَدْ بَرِئَتْ مِنْهُ الذِّمَّةُ " (١)، ،

Translation

English translation

It is narrated from a companion that the Prophet (peace be upon him) said: Whoever sleeps on the roof of a house that has no parapet, and he falls from it and dies, then no one is responsible for him. And whoever sets out on a sea journey at a time when the sea is turbulent and he dies, then no one is responsible for him either.
