حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، وَعَبْدُ اللهِ بْنُ بَكْرٍ، قَالَا: حَدَّثَنَا سَعِيدٌ، عَنْ قَتَادَةَ، عَنْ حَبِيبِ بْنِ سَالِمٍ، قَالَ ابْنُ بَكْرٍ: مَوْلَى النُّعْمَانِ بْنِ بَشِيرٍ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، أَنَّهُ رُفِعَ إِلَيْهِ رَجُلٌ غَشِيَ جَارِيَةَ امْرَأَتِهِ، فَقَالَ: " لَأَقْضِيَنَّ فِيهَا بِقَضِيَّةِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: إِنْ كَانَتْ أَحَلَّتْهَا لَكَ، ، جَلَدْتُكَ مِائَةَ جَلْدَةٍ، وَإِنْ كَانَتْ لَمْ تُحِلَّهَا لَكَ، رَجَمْتُكَ " قَالَ: فَوَجَدَهَا قَدْ كَانَتْ أَحَلَّتْهَا لَهُ، فَجَلَدَهُ مِائَةً (١)،
Translation
English translation
Habib bin Salim (may Allah have mercy on him) says that once a man was brought to Nu’man (may Allah be pleased with him), whose wife had made it lawful for her husband to benefit from her slave-girl. He said, “I will give the same verdict regarding this as the Prophet Muhammad (ﷺ) did. If his wife has permitted him to benefit from her slave-girl, I will give him one hundred lashes, and if she has not permitted, I will stone him to death.” It was found that his wife had given permission, so he gave him one hundred lashes.
