حَدَّثَنَا حَسَنٌ، قَالَ: حَدَّثَنَا ابْنُ لَهِيعَةَ، قَالَ: حَدَّثَنَا عُبَيْدُ اللهِ بْنُ أَبِي جَعْفَرٍ، عَنِ الْفَضْلِ بْنِ الْحَسَنِ بْنِ عَمْرِو بْنِ أُمَيَّةَ الضَّمْرِيِّ قَالَ: سَمِعْتُ رِجَالًا مِنْ أَصْحَابِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَتَحَدَّثُونَ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: " إِذَا أُعْتِقَتْ الْأَمَةُ وَهِيَ تَحْتَ الْعَبْدِ فَأَمْرُهَا بِيَدِهَا، فَإِنْ هِيَ أَقَرَّتْ حَتَّى يَطَأَهَا فَهِيَ امْرَأَتُهُ لَا تَسْتَطِيعُ فِرَاقَهُ " (١)، ،

Translation

English translation

It is narrated from several Companions (may Allah be pleased with them) that the Prophet (ﷺ) said: When a slave woman is granted her freedom, she is given the choice, provided that her husband has not had intercourse with her; if she wishes, she may separate from her husband. But if he has had intercourse with her, then she no longer has this choice and cannot separate from him.
