حَدِيثُ الضَّحَّاكِ بْنِ سُفْيَانَ (١)، ١٥٧٤٥ - حَدَّثَنَا عَبْدُ الرَّزَّاقِ، حَدَّثَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ، قَالَ: مَا أَرَى الدِّيَةَ إِلَّا لِلْعَصَبَةِ، لِأَنَّهُمْ يَعْقِلُونَ عَنْهُ، فَهَلْ سَمِعَ أَحَدٌ مِنْكُمْ مِنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ شَيْئًا؟ فَقَالَ الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلَابِيُّ - وَكَانَ اسْتَعْمَلَهُ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَلَى الْأَعْرَابِ - كَتَبَ إِلَيَّ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " أَنْ أُوَرِّثَ امْرَأَةَ أَشْيَمَ الضَّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا "، فَأَخَذَ بِذَلِكَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ (٢)، ، . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .، ،

Translation

English translation

Saeed bin Musayyib says that once Umar said: "I think that the blood money (diyah) should be given to the 'asaba (male agnates), because they are his family. Has anyone among you heard the Prophet (peace be upon him) say anything about this?" Upon this, Dahiq, whom the Prophet (peace be upon him) had appointed as an official over the Bedouins, said: "The Prophet (peace be upon him) wrote to me in a letter that I should consider the wife of Ashim Dhababi as an heir in her husband's blood money." And upon this, Umar began to act according to this hadith.
