حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، حَدَّثَنَا شُعْبَةُ، وَحَدَّثَنَي حَجَّاجٌ، قَالَ: حَدَّثَنِي شُعْبَةُ قَالَ: (٣) سَمِعْتُ قَتَادَةَ يُحَدِّثُ، عَنْ أَنَسِ بْنِ مَالِكٍ، " أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أُتِيَ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ، فَجَلَدَهُ بِجَرِيدَتَيْنِ نَحْوَ الْأَرْبَعِينَ "، قَالَ: وَفَعَلَهُ أَبُو بَكْرٍ. فَلَمَّا كَانَ عُمَرُ اسْتَشَارَ النَّاسَ، فَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ: أَخَفُّ الْحُدُودِ ثَمَانُونَ، قَالَ: " فَأَمَرَ بِهِ عُمَرُ " (٤)، ،
Translation
English translation
It is narrated from Anas (may Allah be pleased with him) that a man who had drunk alcohol was brought to the Prophet (ﷺ). The Prophet (ﷺ) struck him about forty times with two branches. Abu Bakr Siddiq (may Allah be pleased with him) did the same. But when the caliphate of Umar Farooq (may Allah be pleased with him) began, Umar (may Allah be pleased with him) consulted regarding this matter. Abdur Rahman bin Auf (may Allah be pleased with him) gave the opinion that the lowest prescribed punishment is eighty lashes. Thus, Umar (may Allah be pleased with him) fixed the punishment for drinking alcohol at eighty lashes.
