حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، قَالَ: حَدَّثَنَا سَعِيدٌ، عَنْ قَتَادَةَ، عَنْ خِلَاسٍ، عَنْ أَبِي رَافِعٍ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَجُلَيْنِ تَدَارَءَا فِي دَابَّةٍ، لَيْسَ لِوَاحِدٍ مِنْهُمَا بَيِّنَةٌ، فَأَمَرَهُمَا رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ يَسْتَهِمَا عَلَى الْيَمِينِ، أَحَبَّا أَوْ كَرِهَا " (١)، ،

Translation

English translation

It is narrated from Abu Huraira (may Allah be pleased with him) that there was a dispute between two men regarding an animal, but neither of them had any witnesses to prove their ownership. So the Noble Prophet (ﷺ) ordered them to draw lots for the oath, either willingly or by compulsion (whoever's name was drawn would take the oath).
